229 - TRANSGRESSORS OF CERTAIN COMMANDMENTS TO BE STONED


Deuteronomy 22:23-24 -- 23 "If a young woman who is a virgin is betrothed to a husband, and a man finds her in the city and lies with her, 24 then you shall bring them both out to the gate of that city, and you shall stone them to death with stones, the young woman because she did not cry out in the city, and the man because he humbled his neighbor's wife; so you shall put away the evil from among you.”

A complete list of the commandments for which death by stoning is the penalty is to be found in “Mishneh Torah”.* The provisions of this commandment are explained in the sixth chapter of Sanhedrin.

In connection with this group of commandments – i.e. pos. comm. 225- 230 inclusive – it should be remembered that no ordained court had the authority to administer capital punishment save at the time of the existence of the Temple, and at the time also when the great court, or Sanhedrin, held its sessions in the Chamber of Hewn Stones, in the Court of the Israelites. Thus, forty years before the destruction of the second temple, when owing to the political chaos then prevailing, and because of its inability to enforce its laws, the great court voluntarily abandoned the Chamber of Hewn Stones; no court in Israel had any longer the jurisdictional power to try capital cases.*
